Appellate law refers to the court appeals process used when a party or parties are dissatisfied with their lower court verdict or judgment. Generally, appellate attorneys help clients under one of two circumstances:
- When a client has lost a case, or is unhappy with a ruling. For instance, if you have lost custody of a child, been convicted of a crime, or have lost a judgment or have won a judgment but feel it does not adequately compensate you for your loss, you can appeal the decision.
- When a client has won a case and the losing party appeals the decision. Even if you won the case in lower court, you will have to fight for your rights again if the case is appealed.
Most law firms do not practice appellate law, handle cases on appeal only rarely, or handle appellate cases only when they handled the lower court case.
