One of the most difficult issues to navigate in divorce is child custody — and yet, at the same time, it can also be one of the easiest. What we mean by the latter is that most divorcing couples with a child agree to a joint custody arrangement, thereby allowing each parent to have an active role in their kid’s life. They’ll still get to see their son or daughter on a frequent basis, and play an active role in their development.
However, there are times where the splitting couple files for divorce under very bitter circumstances, and the two soon-to-be-former spouses are unable to reach an amicable child custody arrangement. In these cases, the parents will have to prove to a court why they are fit to have sole physical or legal custody over their children. It can be a heartbreaking and difficult process (especially when you consider having to substantiate your “parenting credentials” to a judge), but it is a possibility for some divorcing couples. They need to be prepared for such a possibility.
Hopefully that does not happen to Taye Diggs and his wife Idina Menzel in the coming month. The celebrity couple announced recently that they were separating. They have a son who was born in 2009.
It seems that, based on the announcement by Diggs and Menzel, that the split is a legal separation, and not an official divorce — at least not yet. As the weeks and months go by, it is likely more information will come out regarding their split.
